Terms of Service

1. Agreement and Acceptance

These Terms of Service (the “Terms” or “Agreement”) constitute a legal agreement between PMC Baltic FZ-LLC (LICENCE NO: 45001684), with registered address at SFFO0507 Compass Building, Al Shohada Road, AL Hamra Industrial Zone-FZ, Ras Al Khaimah, United Arab Emirates (“PMC Baltic”, “THEASTROLOGIST”, the “Service”, the “Site”, “App”, “we”, “us”, or “our”), and any person who accesses, browses, uses, purchases, subscribes to, or otherwise interacts with the THEASTROLOGIST website, mobile application, digital content, digital services, member platform, or related features (the “User” or “you”).

By accessing, browsing, using, purchasing, subscribing to, or otherwise interacting with the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you must immediately stop using the Service.

2. Service

THEASTROLOGIST provides access to digital astrology content, personalized readings, spiritual guidance, educational materials, member-only content, subscription-based features, AI-powered tools where available, and related digital services.

While your membership remains active, you may access content available through the THEASTROLOGIST platform, including personalized astrology readings, birth chart insights, spiritual guidance materials, educational resources, digital programs, interactive tools, and any future content or features that may be added.

Some parts of the Service may be accessible without creating an account, while other parts may require registration, member access, login credentials, purchase confirmation, or email-based delivery.

We may modify, update, suspend, discontinue, or remove any part of the Service at any time, subject to applicable law.

3. License and Use Restrictions

3.1 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service solely for your personal, non-commercial use.

3.2 Restrictions

Except as expressly permitted by these Terms, you may not:

• copy, reproduce, distribute, transmit, publish, resell, rent, lease, sublicense, or commercially exploit any part of the Service;
• modify, adapt, translate, reverse engineer, decompile, or create derivative works from the Service except where prohibited by applicable law;
• use robots, scrapers, crawlers, automation tools, AI extraction tools, or similar methods to access or interact with the Service;
• interfere with or disrupt the Service, servers, systems, or networks connected to the Service;
• circumvent or attempt to circumvent security, access, anti-copying, or subscription protection measures;
• share, transfer, resell, or otherwise provide account access or subscription access to third parties.

4. Intellectual Property

4.1 Ownership

The Service is licensed, not sold.

We and our licensors retain all right, title, and interest in and to the Service, including all content, astrology readings, spiritual guidance materials, educational materials, digital programs, AI-generated content, software, materials, trademarks, logos, branding, design elements, and intellectual property rights.

4.2 Content

All text, astrology readings, spiritual guidance materials, educational materials, digital programs, graphics, software, audio, video, visual elements, downloadable materials, AI-generated content, branding, and other materials made available through the Service are owned by us and/or our licensors and are protected by applicable intellectual property laws.

4.3 Personal Use Only

All content is provided solely for personal, non-commercial use.

You may not copy, republish, redistribute, reproduce, train AI models on, scrape, extract, exploit, or otherwise use any content except as expressly permitted by these Terms.

4.4 Enforcement

We reserve the right to take action under applicable law in relation to unauthorized use of the Service or infringement of our rights.

5. Payment, Subscriptions, and Renewals

5.1 Paid Services

Certain features of the Service are available only through a paid subscription or other paid access model.

5.2 Plan-Specific Charges

By purchasing a subscription, you agree to the initial and recurring charges applicable to the selected THEASTROLOGIST Plan at checkout, including any trial period, introductory price, renewal price, and billing interval disclosed at checkout, purchase confirmation, and Subscription Terms.

5.3 Automatic Renewal

If you purchase a recurring subscription, you authorize us and/or our third-party payment processor to automatically charge your selected payment method for each recurring billing period until cancellation.

5.4 Cancellation

You may cancel your subscription through available account settings or by contacting hello@theastrologist.ai.

To avoid the next recurring charge, you must cancel before your next billing date, including before the end of any applicable trial period.

Because renewal processing may begin shortly before the next billing date, we strongly recommend completing cancellation at least 24 hours before the applicable trial period or billing period ends.

5.5 Access After Cancellation

If you cancel, access will remain active until the end of the then-current paid trial period or billing period, after which the subscription will terminate automatically unless otherwise stated in the Subscription Terms.

5.6 Refunds and Money-Back

Refund eligibility is governed exclusively by the Money-Back Policy, Subscription Terms, and applicable law.

5.7 Review Period for Refund Requests

Where a refund, reimbursement, charge dispute, or similar request is submitted, we may take up to twenty (20) business days from receipt of all required information to:

• review the request;
• analyze supporting evidence;
• verify account activity;
• verify usage data;
• perform internal investigations;
• determine eligibility for approval or denial.

6. Privacy

We process personal data in accordance with our Privacy Policy.

By using the Service, you acknowledge that personal data submitted through the Service may be processed as described in the Privacy Policy.

7. Account, Access, Suspension, and Termination

7.1 User Responsibility

You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out through your account.

7.2 Suspension or Termination by Us

We may suspend, restrict, or terminate your account and/or access to the Service if we reasonably believe that:

• you violated these Terms or any incorporated policy;
• payment failed or was reversed;
• subscription access is being shared, transferred, or resold;
• the Service is being misused or accessed fraudulently;
• prolonged inactivity applies;
• suspension or termination is necessary for legal, operational, abuse-prevention, or security reasons.

8. Copyright and Intellectual Property Complaints

If you believe that any content available through the Service infringes your intellectual property rights, please send a notice to hello@theastrologist.ai with sufficient information for us to investigate the claim.

We reserve the right to investigate and take appropriate action.

9. Disclaimers

9.1 “As Is” and “As Available”

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis without warranties of any kind.

9.2 No Guarantee of Results

We do not guarantee that use of the Service will produce any particular outcome, insight, life change, personal transformation, spiritual result, emotional result, relationship result, educational achievement, or other result.

9.3 AI Features Disclaimer

Certain features of the Service may use artificial intelligence technologies, including AI-generated recommendations, personalized content, responses, educational guidance, astrology insights, spiritual guidance, or other outputs.

AI-generated outputs may contain inaccuracies, incomplete information, fictional information, or content generated automatically without human review.

AI-generated content is provided for informational and educational purposes only and should not be relied upon as medical, psychological, therapeutic, legal, financial, relationship, spiritual, or other professional advice.

9.4 Astrology and Spiritual Guidance Disclaimer

The Service provides astrology, spiritual guidance, educational, and informational content only.

Nothing available through the Service constitutes professional advice, including medical, psychological, therapeutic, legal, financial, relationship, or other regulated professional advice.

Astrology readings, spiritual guidance, AI-generated insights, recommendations, and other content are provided for personal reflection, entertainment, educational, and informational purposes only.

You are solely responsible for your decisions, actions, interpretations, and reliance on any information provided through the Service.

9.5 No Warranty

To the maximum extent permitted by law, we do not warrant that:

• the Service will meet your expectations;
• the Service will be uninterrupted, timely, secure, or error-free;
• content, recommendations, readings, educational materials, spiritual guidance, or AI-generated outputs will be accurate, complete, or reliable;
• defects will always be corrected.

10. Limitation of Liability

To the maximum extent permitted by applicable law, PMC Baltic FZ-LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, business, opportunity, or data arising out of or related to:

• your use of or inability to use the Service;
• your purchase of or reliance upon the Service;
• interruption, suspension, termination, or modification of the Service;
• unauthorized access to or alteration of your data;
• third-party conduct, payment processors, or services;
• AI-generated outputs, astrology readings, spiritual guidance, recommendations, educational content, or other materials;
• failure to cancel before the next billing date.

11. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless PMC Baltic FZ-LLC, its affiliates, directors, officers, employees, contractors, licensors, and agents from and against any claims, liabilities, losses, damages, costs, or expenses arising from:

• your breach of these Terms;
• misuse of the Service;
• violation of applicable law;
• infringement of third-party rights.

12. Dispute Resolution

12.1 Arbitration

To the maximum extent permitted by law, any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be resolved by binding arbitration administered under the LCIA Rules.

12.2 Individual Basis Only

Arbitration shall be conducted solely on an individual basis.

Class actions, collective actions, representative actions, and similar proceedings are not permitted.

12.3 Opt-Out

You may opt out of arbitration by emailing hello@theastrologist.ai within thirty (30) days of first accepting these Terms.

12.4 Non-Arbitrable Matters

If a dispute is found not to be arbitrable, or the arbitration provision is found unenforceable, the dispute shall be resolved exclusively by the competent courts of Ras Al Khaimah, United Arab Emirates, unless mandatory consumer law provides otherwise.

12.5 Interim Relief

Nothing in this section prevents either party from seeking injunctive, protective, or interim relief from a court of competent jurisdiction where necessary.

13. Notices

13.1 Methods of Notice

We may provide notices by:

• email;
• account notification;
• posting on the Service;
• other reasonable communication methods.

14. Term and Survival

These Terms take effect when you first access or use the Service and remain in effect until terminated.

Any provisions that by their nature should survive termination shall survive, including Sections 4 through 17.

16. Miscellaneous

16.1 Governing Law

These Terms and your use of the Service shall be governed by the laws of the United Arab Emirates, excluding conflict-of-laws principles, subject to any mandatory consumer protection laws applicable to you that cannot be contractually excluded.

16.2 Entire Agreement

These Terms, together with all incorporated policies, constitute the entire agreement between you and us regarding the Service.

16.3 Severability

If any provision is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.4 No Waiver

Failure to enforce any provision shall not constitute a waiver of that provision.

16.5 Assignment

We may assign or transfer our rights and obligations under these Terms to another entity, affiliate, successor, purchaser, or as part of a business transfer.

16.6 Force Majeure

We shall not be liable for delays or failures caused by events beyond our reasonable control, including internet outages, cyber incidents, hosting failures, payment processor issues, natural disasters, governmental actions, labor disputes, riots, wars, terrorism, or infrastructure disruptions.
